We regard data protection as a customer-oriented quality feature

Since the protection of your personal data is important to us, particularly in terms of the protection of personal privacy when processing and utilizing this information, we would like to inform you of the following points:

PRIVACY POLICY

At Schenker of Canada Limited, including its affiliates and subsidiaries (collectively, the “Company”), the protection of your personal information is a matter of utmost importance. This Privacy Policy (the “Policy”) is the Company’s policy regarding the collection, use and disclosure, if any, of personal information from you.

Any personal information you provide to us will be treated with care and, subject to this Policy and applicable law, will not be used or disclosed in a way to which you have not consented. By submitting your personal information to the Company, you signify your consent to the collection, use and disclosure of your personal information in accordance with this Policy. If you do not consent to the collection, use and disclosure of your personal information in accordance with this Policy, please do not provide any personal information to the Company.

Personal Information

“Personal Information” means information about an identifiable individual or any information that allows an individual to be identified, including information such as name, date of birth, home address, and financial and credit information.

We may use your Personal Information to provide you with products and services or to bill you therefor, to market products and services which appear to be of interest to you, or to communicate with you for purposes that we inform you about when we collect the information. On the one hand, our aim is to supply you with information that satisfies your interests and preferences. On the other hand, we would like our offers to be precisely what you are looking for and meet your specific requirements.

Limiting Collection, Use and Disclosure

We strive to limit the amount of personal information we collect to that necessary and appropriate for the identified purposes. We will not use or disclose your personal information for purposes other than those for which it was collected, except with your consent or as permitted or required by applicable law.

Disclosure and Handling of Personal Information

If the Company is involved in a merger or other reorganization, it may disclose your personal information to the resulting organization.

The Company may also disclose personal information as otherwise required or permitted by applicable law.

The Company may store and process your personal information at its offices in Canada, or elsewhere. To help protect the confidentiality of your personal information, the Company employs security safeguards that are customary and appropriate to the sensitivity of the information, including physical, organizational and technological measures. Examples of such measures include restricted access to offices, training of personnel, limiting access to information on a “need-to-know” basis, using passwords and well-defined internal policies and practices.

To the extent the Company employs third-party service providers to store, handle or process personal information on our behalf (e.g. data processing or office services), we will use contractual and other means to provide a comparable level of protection while the information is being stored, handled or processed by them.

Consent

To the extent possible, we will obtain your consent to collect, use and disclose personal information about you. However, if you provide personal information concerning another individual, you represent that, prior to submitting such information, you have obtained the necessary consent or authority to permit us to collect, use and disclose such personal information for the purposes set out in this Policy, or the collection, use and disclosure is permitted by applicable law.

The Company will not collect, use or disclose personal information without the consent of the individual(s) concerned unless we are permitted or required to do so by applicable law.

You may withdraw your consent at any time to the use and disclosure of personal information , subject to applicable legal and contract restrictions. If you wish to withdraw your consent, please contact our Privacy Official identified below.

Access

You may request access to your personal information and/or information about the Company's collection, use and disclosure of that information by contacting our Privacy Officer, in writing, at the addresses identified below.

Accuracy

We will keep your personal information as accurate, complete and up-to-date as necessary for the purposes for which it is to be used.

Accountability

When we use trusted third parties to act on our behalf by performing such functions as fulfilling orders, delivering packages, processing payments or providing customer service, contractual or other appropriate means are used to ensure compliance by such third parties with this Policy and all applicable privacy laws.

Our website may contain links to other websites. We are not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by the Company.

E-mail Communications and Your Right to Opt-Out

If you provide your e-mail address to us, you consent to our use of your e-mail address to notify you of information that may affect your account, or to provide you with the information you have specifically requested, or to provide you with information and offers which we think may be of interest to you. If you send us an e-mail message, you also consent to our use of your e-mail address to answer the message we received from you. Your e-mail address will not be used for any purpose other than those listed above.

Changes to Privacy Policy

 Privacy laws are rapidly evolving and, as a result, this Policy may be changed by the Company from time to time in the Company’s full discretion without any prior notice or liability to you or any other person. The collection, use and disclosure of your personal information by the Company will be governed by the version of this Policy in effect at that time.
